SALE OR USE OF TOBACCO ON SCHOOL PREMISES – AR

I. The procedure for ensuring a tobacco free school environment within Talbot County

Public Schools is as follows:

A. The sale and/or use (including possession by students) of tobacco or tobacco products including all electronic or other smoking devices is strictly prohibited on school property at all times.

B. Nicotine replacement therapy such as the nicotine patch, nicotine gum, etc. is allowed when prescribed by a physician. See Administering Medications to Students Policy Code 10.27.

C. The Board of Education will identify, encourage, and support smoking cessation programs for its students and employees to the extent possible.

D. Each school administrator will consistently articulate these guidelines in writing to his/her staff, students, and parents. The Superintendent or Superintendent's Designee will arrange to properly articulate these guidelines county-wide to the public at large as well as to those groups or organizations that use school facilities.

E. Consequences to employees for violation of A and/or B above will involve a progressive disciplinary procedure:

1st Offense - Written warning by administrator and suggestion for enrollment in a smoking cessation program.

2nd Offense - Law enforcement referral by Administrator or designee invoking violation of County Ordinance; letter of reprimand for insubordination; suggestion for enrollment in a smoking cessation program.

3rd Offense - Same as for 2nd offense with written warning that further disciplinary action will be initiated in accordance with Education Article 6-202 for the 4th offense.

4th Offense or More - Disciplinary action initiated in accordance with Education Law

6-202.

F. Consequences to non-employees for the violation of A and/or B above are as follows:

1st Offense - Warning by administrator.

2nd Offense - Law enforcement referral if in violation of County ordinance.

3rd Offense - Same as for 2nd offense along with a Superintendent's order for no trespassing on school grounds at anytime.
