BOARD OF EDUCATION LEGAL STATUS
The Board of Education affirms that it has the legal status and duties which are prescribed in the Education Article of the Annotated Code of Maryland, excerpts of which follows:
I. Section 3-104. County board is a corporate body; general powers.
A. Corporate body. - Each county board is a body politic and corporate by the name of the
Board of Education of Talbot County.
B. General Powers. - A county board:
(1) Has perpetual existence;
(2) May sue and be sued; and
(3) May have, use, alter, or abandon a common seal.
II. Section 4-101. Control and promotion of education.
A. Control of educational matters. - Educational matters that affect the counties shall be
under the control of a county board of education in each county.
B. Promotion of schools. - Each county board shall seek in every way to promote the
interests of the schools under its jurisdiction.
III. Section 4-107. Duties in general.
A. Each county board shall:
(1) To the best of its ability carry out the applicable provisions of this article
and the bylaws, rules, regulations, and policies of the State Board;
(2) Maintain throughout its county a reasonably uniform system of public
schools that is designed to provide quality education and equal educational
opportunity for all children;
(3) Subject to this article and to the applicable bylaws, rules, and regulations
of the State Board, determine, with the advice of the county
superintendent, the educational policies of the county school system; and
(4) Adopt, codify, and make available to the public bylaws, rules, and
regulations not inconsistent with State law, for the conduct and
management of the county public schools. (An. Code 1957, art. 77, SS
